Bolobo Ltd Bookings Terms & Conditions

“Properties” means the property listed on the booking and pre arrival form.
“Booking Form” means the electronic booking form incorporating these T&Cs that the group leader and each person listed in the group electronically agree to.
“Group Leader” means the person listed as such on the booking and pre arrival form.
“Booking” and “Reservation” refer to the contract made between Bolobo and the client.
The person who completes the booking form does so as an agent for all persons named on it. He/she/they agrees to be bound by these terms and conditions and acknowledges that these terms and conditions apply to all such persons listed on the booking and pre arrival form.
Bolobo Ltd. shall be entitled to vary, amend and/or otherwise change these terms and conditions at any time without prior notice.
AGREEMENT
The T&Cs contained in this document, together with your booking form, comprise the contract between Bolobo Ltd. and all persons listed on the booking. The contract is deemed to have been made as soon as the booking confirmation has been sent and accompanied by a NON REFUNDABLE Deposit or full payment as applicable.
The group leader is responsible, on behalf of all other members of the group, for all matters relating to the booking, thus he / she / they will be personally liable for all monies outstanding from the remainder of the guests.
“The Group” refers to all persons booked to stay in the property listed on the booking form and also includes any subsequent changes of names to the original booking.
If at any time, prior to the start of the holiday, there is a change of group leader, Bolobo must be notified, either by email or telephone, by the original group leader.
Under no circumstances are additional guests allowed to stay in the Property other than those specified on the pre arrival form. Failure to comply with this may result in your booking being terminated immediately in resort and you and your party being asked to vacate the relevant Property. No refunds, credit vouchers or compensation will be paid for this.
Recovery of money via a credit card provider, i.e. Chargeback: “Chargeback” is a system developed by payment card providers to protect consumers when a fraudulent transaction has occurred, when a company has ceased trading due to bankruptcy or when a card transaction was not authorised by the consumer.
By agreeing to these terms and conditions you agree to NOT ATTEMPT to recover any of the non-refundable parts of your reservation via your payment card provider unless,
Attempting to recover any non refundable part of your reservation with a chargeback incurs bank charges and significant administrative and legal costs for us. All of these costs and charges will be passed on to you and our legal representatives will pursue you directly for any monies taken from our bank account and for all costs, fees and charges incurred as a result.
STANDARD DEPOSIT TERMS – BOOKING DEPOSIT
A 50% NON-REFUNDABLE deposit is taken at the time of booking.
The remaining 50% payment is taken 28 days before arrival date.
Your booking reserves the whole self-catered property on an exclusive use basis. Therefore, the group leader is liable for the full cost of that property as stated on the booking form, irrespective of party size and final number of guests confirmed.
DAMAGE DEPOSIT & LOST, STOLEN AND DAMAGES TO PROPERTY, ADDITIONAL CLEANING AND BREAKAGES
A payment request for a £2000 damage deposit will be sent shortly after the booking is made. This is required to secure the booking.
This damage deposit will be held securely on our booking platform, and is to be returned within 7-days of departure, assuming no damage to the property.
Any loss or damage, wherever or however caused; or arising by the group leader, or members of the group; to vehicles, property, grounds and outbuildings owned by or managed by Bolobo must be paid for in full. The sums will be taken from the damage deposit, with an itemised list sent to the group leader. Should damages totalling more than the security deposit be done, this is payable by the group leader, on behalf of the group, irrespective of which person was responsible, before guest departure.
Any client not properly securing the exits or windows of the property, including balcony, garage and hot-tub access doors, will be liable for any and all Bolobo property stolen or damaged as a result of that negligence.
Our keys for self-catered properties are security keys, therefore, should you lose a key, you will be charged €250 for a replacement.
Bolobo will endeavour to deal with any loss or damage issues during your stay. In the event that damage is not brought to our attention during this period, and is learned of after your departure, Bolobo will contact you within 72 hours of you leaving the Property to confirm additional charges to be charged.
Bolobo will not be held responsible for any theft or loss of any personal possessions from our premises / vehicles. Whilst Bolobo will endeavour to ensure the security of guests’ personal possessions, Bolobo cannot guarantee it.
It is up to the Group Leader to ensure that each member of the party is responsible for the safety of all their own personal possessions, documents and equipment. No responsibility or liability will be accepted in respect of such items as it is a condition of your booking (and therefore reasonably assumed by Bolobo) that all guests have taken out appropriate insurance to cover such loss and/or damage. For the avoidance of doubt, please note that this section also applies to mountain bikes, road bikes, ski/snowboard equipment and any other “high value items” that guests have brought with them on holiday.
DO NOT use abrasive cloths or abrasive cleaning products in the apartment. Any damage caused to polished or metal surfaces will be charged to you.
DO NOT dry dark or coloured clothing on radiators, fireplaces or heated towel rails. Any damage caused will be charged to you.
DO NOT wash shoes or trainers or inappropriate clothing in any of the washing machines, and ensure all pockets are emptied. You are liable to pay for any repairs, replacement parts or full replacement of washing machines and tumble driers on a like for like basis if any damage is caused.
Any additional charges for cleaning or replacement of linen or towels due to staining arising from makeup or cosmetics will be taken from the damage deposit.
PRICES
The prices quoted on the Bolobo website are for accommodation on a self-catered basis unless otherwise stated. Our self catered prices DO NOT include Morzine Tourist Tax (Tax De Séjour), or any additional services (for example, meals on wheels, shopping packs, airport transfers, flights or travel costs; travel, holiday or medical insurance; lift passes; childcare; equipment hire or lessons). Therefore, the Package Travel Regulations and Linked Arrangement Regulations do not apply to the services provided by Bolobo. PLEASE NOTE that reservations made for self catered properties classed as “Self Catered with Services” will include a midweek linen change and a mid week clean of the property.
Bolobo guarantees the price of your holiday as quoted at the time of booking and as stated on your booking form. Bolobo reserves the right to increase or decrease the advertised price of any unsold holidays at any time.
Morzine Tourist Tax – This is charged at the local nightly per person rate for the accommodation.
Morzine Tourist Tax and any other additional charges will be added to your booking, once we have confirmed your reservation and the number of people in your party. Bolobo will make these calculations on your behalf, based on the information provided by you on your booking form. All tourist tax monies owing will be collected 28 days (4 weeks ) before the start of your holiday at the same time as your final balance is due.
PASSPORTS, VISAS & INSURANCE
Please Note – You must ensure you have adequate travel insurance to cover you for all travel cancellations, including cancellations due to Covid-19. OUR STANDARD TERMS AND CONDITIONS STATE THAT ANY DEPOSITS PAID ARE NON REFUNDABLE (see Section 6.0).
It is your responsibility to be in possession of a valid passport and / or any visa necessary. If you do not have a British or EU passport, please be sure to check visa requirements for the countries you will be visiting. Remember, most flights are to Geneva in Switzerland which is not an EU member.
You MUST be insured with valid medical and travel insurance policies to fully cover yourself, and your property/belongings before partaking in a Bolobo holiday. These policies are there to cover you for any injuries or unforeseen circumstances, including and not limited to theft and damage to Bolobo property as a result of your actions / behaviour or negligence, and for loss of holiday costs due to forced closure of the resort due to circumstances including and not limited to, force majeure, lack of snow / bad weather, cancelled flights and travel arrangements, pandemics, epidemics and specifically COVID-19.
GENERAL CANCELLATION POLICY & TERMS
You, or any member of your party, may cancel your holiday at any time for any reason provided that the Group Leader makes the cancellation in writing / email. Charges will be levied in accordance with our cancellation policies as outlined in sections 6.3
Bolobo takes no responsibility for non-delivery or non-receipt of such written cancellation.
(a) Cancellation up to 28 days (4 weeks ) before commencement of your holiday: All deposits paid are NON REFUNDABLE.
(b) Cancellation at 28 days or less before the commencement of your holiday: All deposits paid are NON REFUNDABLE and you are also liable to pay 100% of the total cost due for your holiday.
The final balance outstanding on your holiday must be paid 28 days (4 weeks) before the start date of your holiday with Bolobo. If the final balance is not received 28 days (4 weeks) before the start date of your holiday with Bolobo, we reserve the right to cancel the booking, retain any deposit paid, and levy cancellation charges as outlined in the Cancellation Section. Bolobo reserves the right to re-advertise and re-book the same week in the same accommodation to another client without notification.
Non receipt of the balance of the cost of the holiday will not be taken as notification of cancellation; clients will still be liable for cancellation charges as shown above if they subsequently cancel their holiday.
Cancellations or major changes made by Bolobo, outside of COVID-19 and Force Majeure: Arrangements for holidays are made in advance, and changes can occur. Bolobo reserves the right to make any necessary alterations to holiday and website details both before and after any booking has been confirmed. Most alterations are minor changes, but occasionally it is necessary to make significant changes or cancel holidays. In all cases we will advise you of any changes at the earliest possible opportunity.
A significant change is one made before departure that involves downgrading your accommodation for a significant proportion of your holiday or the withdrawal of a significant proportion of the facilities or services included as part of your holiday.
When a cancellation or a significant change, outside of Covid-19 and Force Majeure events, is notified to you by Bolobo you have the right to :
Terminate the contract and receive a refund of all sums paid by you for the holiday
b) Accept the change in arrangements
c) Purchase an alternative holiday from us and pay or receive any price difference

Refer to Section 7.0 for FORCE MAJEURE specific cancellation terms and conditions
In addition, in all cases where a significant change or cancellation is made by Bolobo, outside of Covid-19, we will pay you compensation as detailed in section 8.9 below.
EXCEPTIONS – Bolobo will not pay compensation where the change or cancellation is made as a result of events constituting any unforeseeable / extraordinary circumstances beyond our control. This includes Force Majeure (Force Majeure meaning acts of war or threat of war, political unrest, terrorist activities, volcanic ash clouds, strikes, acts of God, riots, civil strife, industrial disputes, terrorist activity, natural or technical disasters, nuclear war) and or similar unforeseeable / extraordinary events out of our control.
Independent travel arrangements that you arrange separately (e.g. flights, airport parking, transfers, car hire etc ) do not form part of our contract with you. If we need to make any changes to, or cancel, your holiday, we will not be liable for any charges incurred by you in respect of your independent travel arrangements.
CANCELLATION DUE TO FORCE MAJEURE
Force Majeure includes, but is not limited to, acts of war or threat of war, political unrest, terrorist activities, volcanic ash clouds, strikes, acts of God, riots, civil strife, industrial disputes, terrorist activity, natural or technical disasters, nuclear war and other similar unforeseeable / extraordinary events out of our control.
If you or Bolobo have to cancel a reservation due to a Force Majeure event, any deposits paid are non-refundable and non-transferable to another holiday date and will be retained for administration costs and charges.
A 50% refund of any final balance payments will be paid to you.
There will be no breach of contract and no payment of additional compensation.
Processing time to issue refunds will be a max of 30 days from the start date of your cancelled holiday.
COVID 19/Similar future event
Please Note: Covid 19 is now a known event, should you be unable to travel because of COVID 19 (or similar) or due to Government Restrictions imposed because of COVID 19 (or similar), then Bolobo is not legally obliged to accept any liability or responsibility, issue refunds, issue credit vouchers and / or pay any other compensation. Therefore, you must ensure you have adequate travel insurance to cover you for all travel cancellations including cancellations due to Covid-19 or any similar pandemics which may arise.
Arrangements for holidays are made in advance, and changes can occur. Bolobo is required to comply with all national and local government regulations and recommendations relating to Covid-19. Therefore, we reserve the right to make any necessary alterations to holiday and website details both before and after any booking has been confirmed, and to make changes to the services and service levels offered during your stay, required by such regulations. In all cases we will advise you of any changes at the earliest possible opportunity. Bolobo does not accept liability or pay compensation for such changes
If you develop symptoms of COVID 19 whilst on holiday and decide to self isolate, Bolobo does not accept liability or responsibility to provide you with accommodation beyond your contracted holiday dates.
If you choose to stay in a Bolobo property to quarantine, Bolobo reserves the right to charge you the full price as advertised on the Bolobo website for your stay in the property.
LIMITATION OF LIABILITY
Bolobo does not accept liability or pay compensation for:
Any unforeseeable / extraordinary circumstances beyond our control. This includes Force Majeure (Force Majeure meaning acts of war or threat of war, political unrest, terrorist activities, volcanic ash clouds, strikes, acts of God, riots, civil strife, industrial disputes, terrorist activity, natural or technical disasters, nuclear war) and or similar unforeseeable / extraordinary events out of our control.
(Please Note that COVID 19 and the effects of it are no longer classed as Force Majeure or unforeseeable / extraordinary circumstances as they are now a known event).
Adverse weather or traffic conditions, avalanche, mud slips, slides and snow conditions and the effect that any of these may have on travel arrangements, accommodation and activities.
Limitations imposed by resort authorities, ski-lifts, ski school or ski hire operators. Including but not limited to resort closure.
Any personal injury or death, where so ever or however arising, caused to any visitor and/or any member of the group for their duration of stay.
These limitations are not intended to exclude any statutory rights the group and/or visitor may have.
These T&Cs and any non-contractual obligations arising out of or in connection with it are governed by French Law.
The courts of France have exclusive jurisdiction to settle any dispute arising out of or in connection with this T&Cs (including a dispute relating to the existence, validity, termination of this T&Cs and any non-contractual obligation arising out of or in connection with either this T&Cs or the negotiation of the contract contemplated by these T&Cs).
A person who is not a party to this Agreement has no right to enforce any term of this Agreement.
ARRIVAL/DEPARTURE TIMES
The Property is available for access from 4 pm on the day of your arrival. Effort will be made to allow early access, however, this must be discussed with Bolobo prior to arrival. Bolobo cannot guarantee the Property will be ready before 4pm.
For departure, the Property must be vacated by 10 am. We can offer bag storage if required on arrival or departure. Effort will be made to allow late checkout under special circumstances only. However, this must be discussed with Bolobo at the time of booking and cannot be guaranteed.
RESPONSIBILITIES & BEHAVIOUR
All guests should act and behave in such a manner so as to not affect or disrupt the enjoyment of local residents or have a negative effect on the reputation of Bolobo.
Bolobo Ltd reserves the right to send guests away from the Property due to their conduct and behaviour or for any other safety, security, medical reasons. This applies in particular, if Guests do not observe instructions given by Property employees, express themselves in a discriminating manner, harass or endanger others.
Bolobo reserves the right to refuse to further accommodate your party if you are in breach of this clause and contractual obligations will be terminated immediately. No compensation will be payable.
If you have any allergies, sensitivities or intolerance to, but not limited to: a particular fabric, material, cleaning product or food, it is the guests responsibility to advise Bolobo Ltd prior to arrival.
FIREPLACES, STOVES AND CHIMNEYS
Care must be taken when using fireplaces, stoves and chimneys. Naked flames, fires, fireplaces and chimneys are hot and can cause serious damage to property, belongings and people. Therefore, fireplaces should never be overloaded with wood, allowed to burn out of control. They should never be left unattended. Clothes or other items should never be dried directly in front of or on top of them.
Bolobo accepts no responsibility for damage to guests, guest clothing or other property belonging to guests as a result of using a fireplace, stove or chimney.
If a guest damages a piece of Bolobo property as a result of using a fireplace, stove or chimney, they will be charged accordingly.
CHILDREN
No matter how much care is taken, our Properties are not childproof. Bolobo will not be held responsible for any accidents occurring within the properties, it is the parent’s responsibility to ensure their children are supervised at all times. Particular care must be taken with hot tubs, fireplaces, chimneys, stair cases, TVs and electrical devices. Parents assume full responsibility for the safety and well being of their children at all times.
Bolobo can provide high chairs, travel cots and car seats for infants and babies and stair gates. These items must be checked over by parents to ensure they are satisfactory and secured. Bolobo accepts no responsibility should an accident or injury occur as a result of the use of such items. Parents assume full responsibility for the safety and well being of their children at all times.
OUTDOOR SHOES AND EQUIPMENT
It is important that, for your comfort, a pair of slippers or indoor shoes are included in your packing as ALL outdoor shoes, which include ski and snowboard boots, mountain biking shoes and cycling shoes are strictly forbidden anywhere inside the Property and the internal communal areas.
All outdoor equipment, which includes but is not limited to mountain bikes, skis and snowboards, dirty, soiled or extremely wet clothing, must be stored in the designated area as provided by Bolobo on arrival.
Under no circumstance is the repair or maintenance and cleaning of such outdoor equipment, as stated above, allowed within the internal space of the property including terraces, balconies and garden areas. Mountain bikes should be washed in the designated area described at check in. This also includes waxing of skis or snowboards in winter.
SMOKING AND ILLEGAL SUBSTANCES
For health and safety reasons, smoking is strictly prohibited inside our Self Catered Properties and Bolobo vehicles. If guests wish to smoke they must do so outside of these areas or within the designated smoking spaces.
Smoking or taking illegal substances in or around any of Bolobo’s properties will not be tolerated. Any guest involved in such activity will be asked to immediately vacate the Property. Bolobo reserves the right to refuse to further accommodate your party if you are in breach of this clause and contractual obligations will be terminated immediately. No refunds or compensation will be payable.
COMPLAINTS
In the unlikely event of you having a complaint with any part of your holiday you should notify the Bolobo staff immediately.
Any complaints made ON or AFTER departure will not be considered. Complaints cannot be accepted for airport transfers, snow conditions, childcare, weather, lessons and closures of ski – lifts and other services provided by 3rd party suppliers or for anything outside of Bolobo’s direct control.
THIRD PARTY SUPPLIERS AND ACTIVITIES
At Bolobo, we pride ourselves in being able to assist in sourcing and booking many of the extra services you may require when on holiday. This does not constitute an approval of these services or suppliers and Bolobo takes no responsibility or liability for 3rd Party services. Therefore, you are subject to the terms and conditions of the individual 3rd party companies and any grievance with a third party service should be taken up with that provider directly.
Our help in organising and recommending 3rd Party suppliers does not constitute a package holiday or linked travel arrangement and therefore falls outside of the Package Travel Regulations.
TERMS OF CONTRACT
All descriptions on the Bolobo website are given in good faith and are believed to be correct. This is in relation to all aspects including activity pricing and information.
For the avoidance of doubt in the event of any conflict between the details on the Bolobo website and the T & Cs, the provisions of the T & Cs prevail.
The contract and the Agreement is made in accordance with these terms and conditions.

Bolobo Ltd reserves the right to change the privacy policy from time to time and guests who are requested to visit our website frequently should check one privacy policy and terms of use to learn about the recent changes.
Personal information collected by Bolobo Ltd.
We collect information about you for 2 reasons: firstly, to process your reservation and second, to provide you with the best possible service.)
The guests have a right to modify or restrict (stop any active) processing of their personal information for any marketing related activities. The guests may opt out of our database by using the “Unsubscribe” option at the footer of our online e-mailers, or by sending an email to hello@bolobo.co.uk.
To ensure that you enjoy the same level of service across the Property, we may share your personal information with Property staff and employees having the responsibility to provide such services to you. While doing so, our Property will ensure that guests’ personal information is handled as per this policy.
If a corporate credit card is used, the billing information may be shared with employer.
The property with or without prior notice to its guests, may have to share some guest information in order to comply with applicable laws or respond to governmental inquiries or requests from public authorities or to comply with valid legal process, to protect the rights, privacy, safety or property of the business, its guests, employees or the public or to permit us to pursue available remedies or limit the damages that we may sustain or to respond to an emergency.
Non-personal or anonymous information collected
Information that does not personally identify a guest is referred to as non-personal or anonymous information. When guests visit and interact with our website the or third parties with whom The Property has contracted to provide services, non-personal information, like, list of website pages visited by guest, could be collected. Technology like cookies could be used to help deliver content as per guest preference, to help guest process their reservations or other requests. While this cannot be used to disclose their identity, this information will identify the browser used by guests to our servers when they visit our site. To remove the cookies at any point from a computer, guests can delete them using their browser.
From time to time, we may allow third party advertisers to advertise on our websites. These third-party advertisers may use technologies like cookies, pixel tags to track which ads the browser used by guests has seen and which site pages they may have visited. The Property has no control over the use of this technology or the resulting information and is not responsible for any actions or policies of such third parties.
